Subclass 820 Visa – Partner Visa Australia
The Subclass 820 partner visa allows non-Australians in genuine relationships with Australian citizens, permanent residents, or eligible New Zealand citizens. This visa is available to heterosexual and same-sex couples. Two relationship statuses’ are eligible for partner visas: DE-FACTO or MARRIED.
MARRIED status means you are legally married in a country where the marriage is recognised under Australian law, which includes most countries.
DE-FACTO is where you’ve been living together for at least 12 months, OR if you have registered your relationship in an Australian state. Relationship registration is available in NSW, QLD, VIC, ACT, TAS, and SA.
The Subclass 820 visa is for people who are located onshore. Once you have submitted the 820 visa, you will be granted a Bridging Visa which will allow you to lawfully stay in Australia. You can also get Medicare once your application is lodged.
Even if your relationship has broken down, you may still be able to get the 820 visa under the following scenarios:
- Sponsor has died
- Joint Child
- Domestic/Family Violence
