If you hold a visa with Condition 8503, 8534, 8535 or 8540 imposed, this generally means you cannot apply for another visa while you are in Australia (exceptions exist such as Protection Visa).

You can make a request for a waiver to get these conditions removed if compassionate and compelling circumstances exist. There has to be circumstances that are considered a ‘major’ change in your situation.

Situations that would be considered a major change are:

  • Medical conditions that make you unable to travel
  • Sickness or death within close family
  • Civil unrest or war in home country
  • Natural Disaster in home country

Once these conditions have been removed, you are then able to make a further application for a visa while you are in Australia.
