Subclass 188 – Business Innovation Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Get an invitation to apply from an Australian State or Territory
- You must have an annual business turnover of AUD$750,000 for at least 2 years in the last 4 years.
- You and your partner must have assets (personal and business) of at least AUD$1.25 million
- Minimum 65 points
- Must be under 55 years old (exception to this is if your business can be demonstrated to have exceptional economic benefit to a State, then you can be older than 55)

Subclass 188 – Investor Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Get an invitation to apply from an Australian State or Territory
- You must have:
- you and your partner has 10% ownership interest in a “qualifying business” OR
- an “eligible investment” of at least AUD$2.5 million that is owned by you and your partner (or either 1 person)
- Must have at least 3 years experience in managing these eligible investments or qualifying businesses
- You and your partner must have assets (personal and business) of at least AUD$2.5 million for the last 2 years before you receive an invite for a 188 investor visa
- Invest AUD$2.5 million in the following proportions in Australia:
- AUD$1.25 million that is categorised as a balancing investment in managed funds
- at least AUD$750,000 in approved managed funds (emerging companies on ASX stock exchange)
- at least AUD$500,000 in growth private equity funds and venture capital
- Minimum 65 points
- Must be under 55 years old (exception to this is if your business can be demonstrated to have exceptional economic benefit to a State, then you can be older than 55)
Qualifying Business is a business that is for making profit by providing goods, services to the public (not rental property) AND does not operate for the purpose of passive or speculative investment.
Eligible investment is to produce return for capital gain or income (not for personal use) and falls into 1 of the following categories:
- real estate
- stock or bonds
- cash on deposit
- gold or silver bullion
- an ownership interest in a business

Subclass 188 – Significant Investor Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Get an invitation to apply from an Australian State or Territory
- Invest AUD$5 million in the following proportions in Australia:
- AUD$2.5 million that is categorised as a balancing investment in managed funds
- at least AUD$1.5 million in approved managed funds (emerging companies on ASX stock exchange)
- at least AUD$1 million in growth private equity funds and venture capital
- Minimum 65 points

Subclass 188 – Business Innovation Extension Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Must hold a Business Innovation and Investment (Provisional) visa (subclass 188) Innovation stream for 3 years (unless COVID-19 exemptions apply)
- Need to demonstrate that you are required to be in Australia to manage your business’ day-to-day issues and your substantial presence is required in Australia for your business to operate
- Business must have been operating for at least 2 years before (unless COVID-19 exemptions apply)

Subclass 188 – Significant Investor Extension Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Only have ever have held ONE Business Innovation and Investment (Provisional) visa (subclass 188) Significant Investor Extension stream visa.
- Must hold your complying significant investment

Subclass 188 – Entrepreneur Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Get an invitation to apply from an Australian State or Territory
- Undertake entrepreneur activity
- Must be doing a complying entrepreneur activity in Australia (innovative idea that will lead to development of business in Australia OR commercial of a product or service). Must not be in labour hire, residential real estate or purchase of an existing business or franchise in Australia.
- Must be endorsed by recognised body

Subclass 888 – Business Innovation Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Hold a 188 Business Innovation stream visa, subclass 444 visa, 188 Business Innovation Extension Stream visa OR 457 visa (applies in certain scenarios) (Note COVID-19 concessions apply)
- Get nominated from an Australian State or Territory
- Owned and Managed Business in Australia
- In 2 years before you apply:
- own at least 51% of a business with annual turnover less than AUD$400,000 OR
- own at least 30% of a business with annual turnover less than AUD$400,000 OR
- own at least 10% of publicly listed company
- Business must have annual turnover of AUD$300,000 in the last 12 months
- In the last 12 months before you apply, must satisfy 2 of the below:
- assets (personal and business) of AUD$600,000 net value
- 2 full-time employees (who are Australian Citizens, Australian PR or NZ passport holders and must not be members of your family)

Subclass 888 – Investor Stream

Subclass 888 – Premium Investor Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Hold a 188 Premium Investor stream visa (Note COVID-19 concessions apply)
- Get nominated from Austrade
- Have held your ‘complying significant investment’ of AUD$15 million for the whole period you held your 188 visa

Subclass 888 – Entrepreneur Stream
Eligibility Criteria:
- At time of application and time of decision, can be inside or outside Australia
- Hold a 188 Entrepreneur stream visa (Note COVID-19 concessions apply)
- Get nominated from State or Territory
- Have successful record of entrepreneurial activities. Have 2 key success factors or 1 key success factor and 3 supporting success factors
Key Success Factors include:
- Having annual turnover of AUD$300,000 minimum
- Parternship with university
- Employing 2 Australian citizens, Australian permanent residents
- getting funding for your entrepreneurial activity
- sale of an entrepreneurial venture with value of 2 million AUD
- Filing a provisional patent, standard or innovation parent
Supprting success factors:
- Getting awards that are formal or recognition
- Getting a statement of success from State or Territory nominator
- getting sponsorship for corporate sector
- adapting entrepreneurial activities into other business areas
- raising or contributing to social capital
- starting 1 business and contributing to 2 other businesses
Activities that are not counted under this visa are, labour hire, residential real estate or buying an existing enterprise or franchise in Australia.

Subclass 890 – Business Owner Visa
Eligibility Criteria:
- Hold a visa (subclass 160, 161, 162, 163, 164 or 165)
- In 2 years before you apply:
- own at least 51% of a business with annual turnover less than AUD$400,000 OR
- own at least 30% of a business with annual turnover less than AUD$400,000 OR
- own at least 10% of publicly listed company
- Net business assets of AUD$100,000
- Business turnover of at least AUD$300,000
- 2 full-time employees (who are Australian Citizens, Australian PR or NZ passport holders and must not be members of your family)
- Business and personal assets of AUD$250,000
