WORK VISA – TEMPORARY SKILLS SHORTAGE – TSS (482)

Subclass 482 (TSS Visa) is where employers sponsor overseas workers. Through the TSS Stream, applicants may have a pathway to permanent residency.

There are 3 streams in the 482 visa. Short-term stream, Medium-Term stream and the Labour Agreement Stream.

The business must be a Standard Business Sponsor (SBS) or an Overseas Business sponsor to sponsor an applicant.

Qualifying visa: The applicant can be outside or inside Australia (but if in Australia, must be on a substantive visa, Bridging Visa A, Bridging Visa B or Bridging Visa C)

3 steps are involved in the 482  TSS visa:

Step 1

  1. Sponsorship (by the employer) – sponsor must be lawful, active, operating a business)
  • Lawfully registered
  • Operating as a business

Documents that may be required in this step are company/sole-trader registration documents, financial documents such as BAS, company tax return, balance sheet etc.

 

Step 2

  1. Nomination – Genuineness of position, Salary details, labour market testing

 

Labour Market Testing – where employer must place ads on a recognised recruitment website, newspaper/medium. Both ads must be at least for 28 days (4 weeks) and must be within last 4 months prior to nomination lodgement date.

Minimum salary of employee must be $73, 150 + Superannuation (TSMIT)

 

Documents that may be required in this step are genuine position report etc.

 

Skilled Australia Fund

If business has an annual turnover of more than 10 million, than $1800 per year that the visa applicant has a visa.

If the business has turnover of less than 10 million, than $1200 per year.

 

Step 3

  1. Visa Application – applicant required at least 2 years experience and must meet character and health requirements.

 

ENGLISH REQUIREMENT

Short Term Stream

International English Language Testing System (IELTS) Overall band score of at least 5.0 with a score of at least 4.5 in each of the test components.
Occupational English Test (OET) Score of at least ‘B’ in each of the four components
Test of English as a Foreign Language internet-based Test (TOEFL iBT) iBT total score of at least 35 with a score of at least 3 for each of the test components of listening and reading, and a score of at least 12 for each of the test components of speaking and writing
Pearson Test of English Academic (PTE Academic) Academic overall test score of at least 36 with a score of at least 30 in each of the test components
Cambridge C1 Advanced test Overall test score of at least 154 with a score of at least 147 in each of the test components.

 

Medium Term Stream

Test Required results
International English Language Testing System (IELTS) Overall band score of at least 5.0 with a score of at least 5 in each of the test components.
Occupational English Test (OET) Score of at least ‘B’ in each of the four components
Test of English as a Foreign Language internet-based Test (TOEFL iBT) iBT total score of at least 35 with a score of at least 4 for each of the test components of listening and reading, and a score of at least 14 for each of the test components of speaking and writing
Pearson Test of English Academic (PTE Academic) Academic overall test score of at least 36 with a score of at least 36 in each of the test components
Cambridge C1 Advanced test Overall test score of at least 154 with a score of at least 154 in each of the test components.

 

The medium-term stream does lead to PR after working with same employer for 3 years on TSS 482 visa.

The short-term stream 482 does not lead to PR through ENS 186; however, discuss with us what other pathways may lead to PR for you.

  • Skills Assessment – A skills assessment is not required for 482 for most occupations. Only required for trade occupations and that too if you have a country of passport from only certain countries.

Documents that may be required in this step are work experience documents, english proof documents, passport etc.
