A person may sponsor up to two people as a spouse, de facto partner, interdependent partner, or prospective spouse (fiancé) under regulation 1.20J(1)(a), with certain exceptions.

If you have sponsored two people in your life on a partner visa, then a waiver may be available to you to sponsor more than two people if you have compelling circumstances.

Compelling Circumstances Affecting the Sponsor’s Interests

Compelling circumstances affecting the sponsor’s interests may include situations such as:

  • The applicant and sponsor have a dependent child who relies on both of them.
  • The death of the previous partner.
  • The previous spouse abandoned the sponsor, leaving them with children who require care and support.
  • The new relationship is longstanding.
  • The nature and extent of the hardship or detriment the sponsor would suffer if the sponsorship were not approved.
  • The depth and importance of the sponsor’s ties to Australia, and the hardship or detriment that would result if the sponsorship were not approved.
